ACI's CFIUS Conference Returns to Address the Evolving Landscape of Inbound Foreign Investments Reviews

NEW YORK - Michimich -- The CFIUS Sector is preparing for a robust review and the American Conference Institute (ACI) will address critical updates and best strategies at its 9^th National Conference on CFIUS taking place at the Hilton Towers Arlington VA from April 13-14, 2023.

"The recent Executive Order that President Biden issued concerning the national security factors that CFIUS should consider and its reviews of transactions, it's the first presidential directive to CFIUS since its founding in 1975. So really noteworthy," says conference co-chair Luci Hague, Partner, Kirkland & Ellis.

Hague references President Joe Biden aim to "Ensure Robust Reviews of Evolving National Security Risks by the Committee on Foreign Investment in the United States," as stated in the EO released September 2022.

"Another very important development is Treasury's long-awaited release of the CFIUS enforcement penalty guidelines, like the executive order that Luci just mentioned. This is another historic first for the committee," says conference co-chair Phil Ludvigson, Partner, King & Spalding, and former U.S. Director in the Office of Investment Security (CFIUS) at the U.S. Department of the Treasury.

CFIUS will be more closely scrutinizing how transactions effect the resiliency of U.S. supply chains, technology, national security, cybersecurity, and persons sensitive data. This comes as the evolving CFIUS regulations are creating an environment of assessment, review, execution, and post-closing supervision that is far more complex than we have seen in CFIUS's 30+ year history. As such, it is now critically important for global businesses to have access to the knowledge needed to make crucial decisions.
