Appeals Court Reverses Judge and Rules Against ACS

NEW YORK - Michimich -- Parents scored a major victory today at the Second Department Appellate Division in New York. Family Court judge Morgan had issued an order prohibiting a parents attorney from being present when ACS worker came to visit. The Law Offices of Michael S. Discioarro, LLC appealed the decision. In a stunning rebuke, the unanimous Appeals Court, reversed the Family Court judge and held in favor of the parent. "This is a stunning decision. It gives parents the right to have attorneys present when ACS comes knocking. This will change ACS procedures from now on. " Mr. Discioarro said.
While the right to counsel is well known in the criminal world, it is less known in family cases. Parents now have the absolute right to have an attorney present when ACS comes to attack them. The decision can be read HERE.
