ABC Law Centers Secures $9 Million Birth Injury Settlement

BLOOMFIELD HILLS, Mich., June 27, 2023 ~ Attorneys Jesse M. Reiter, Anne L. Randall, and James McCullen have secured a $9 million settlement for their client, a 29-year-old pregnant patient with maternal obesity. The plaintiff had been monitored prenatally with non-stress tests and ultrasounds, all of which had normal results. However, when the plaintiff reported decreased fetal movement for the last three days at 38 weeks gestation, she was placed on a fetal monitor which showed her baby had suffered a brain injury from not getting enough oxygen (called hypoxic ischemic encephalopathy—HIE). An emergency C/S was performed and seizures occurred after birth. Hypothermia cooling was performed to treat the brain injury.

The child developed physical and cognitive impairments due to the injury at birth and by age 6 was in special education with cognitive impairments. The plaintiff alleged that if she had been admitted to the hospital three days earlier, she would not have suffered a brain injury from HIE. After the first day of trial, the case settled for $9 million. Attorneys Reiter, Randall, and McCullen were able to secure this settlement for their client despite the difficult circumstances of the case.
