DETROIT - Michimich -- A recent press release by Falcon Creek Books contains false and defamatory allegations against Michigan attorney Steven G. Cohen. The press release concerns a book authored by Elaine Eason Steele (a lifelong friend of civil rights icon Rosa Parks) and Eugene G. Cartwright. Falcon Creek Books (the publisher) claims nonpayment by Elaine Steele under a publishing contract and makes a range of allegations concerning Mr. Cohen and the Rosa Parks Institute. All of these claims and allegations are wholly false.
To begin, Falcon Creek Books is not a party to the publishing contract. The only parties are Mrs. Steele and Mr. Cartwright. Mr. Cohen acted as attorney for Mrs. Steele in the negotiation of the publishing contract with Mr. Cartwright. Mrs. Steele (through her counsel) has repeatedly and directly addressed the breach of contract claims of Mr. Cartwright and has asserted her own claims of breach of contract against him. All of these claims remain unresolved.

The Rosa Parks Institute (also Mr. Cohen's client) is not a party to the publishing contract and has no involvement with or debt to Mr. Cartwright or Falcon Creek Books. Contrary to the press release, the Institute is not "unfunded" or "suffering". Also contrary to the press release, Mr. Cohen has no direct involvement in the Institute's operations, management or finances and has not breached any legal or fiduciary duty owed to the Institute. Mr. Cohen himself is not a party to any contract with Mr. Cartwright or Falcon Creek Books and has no control over or responsibility for the contract between Mrs. Steele and Mr. Cartwright.
Mr. Cartwright and Falcon Creek Books are acting in a wrongful manner. Instead of addressing the opposing breach of contract claims by the parties to the publishing contract, Mr. Cartwright and Falcon Creek Books are attempting to coerce payment by engaging in a defamatory pressure campaign against Mr. Cohen and the Rosa Parks Institute. Mr. Cohen has sent a retraction demand to Cartwright and Falcon Creek Books and intends to file a libel and defamation action against them in Federal District Court in Michigan.
