ANN ARBOR, Mich. - Michimich -- PSED Law is reminding fiduciaries that estates and trusts may have independent federal and Michigan income tax obligations—including the potential requirement to make quarterly estimated tax payments.
When an individual passes away, their estate often becomes a separate taxable entity during the administration process. Similarly, irrevocable trusts are treated as independent taxpayers under federal law.
"Many trustees and personal representatives assume taxes are handled at year-end," said Sarah Meinhart, an estate planning attorney (https://www.psedlaw.com/learn/more/estate-plann...) at PSED Law. "In reality, estimated payments may be required throughout the year to avoid penalties."
Under IRS rules, estates and trusts generally must make quarterly estimated payments if they expect to owe $1,000 or more in tax and withholding does not cover the liability. Michigan requires estimated payments when more than $500 in state income tax is anticipated.

While estates benefit from a two-year grace period from estimated payments, trusts do not receive similar treatment. Because trust tax brackets are compressed, retained income can quickly reach the highest federal tax rate.
Strategic income distributions may reduce tax exposure by shifting liability to beneficiaries, who may be in lower tax brackets.
